Terms of Service

These Terms of Service ("Terms") are an agreement between you and Primpulsive LLC, the legal operator of Fruglar ("Fruglar," "we," "us," or "our"), and govern your use of fruglar.com, Story Studio, Story Maps, the Planner, Fruglar Plus, Done-for-you creative services, and Fruglar travel-booking services (collectively, the "Services"). By creating an account, purchasing a Service, or using the Services, you agree to these Terms and our Privacy Policy.

1. Eligibility and Accounts

You must be at least 18 years old and legally able to enter into these Terms. You are responsible for accurate account information, protecting your credentials, and activity under your account. Notify us promptly of unauthorized use. We may suspend access when reasonably necessary to protect users, investigate fraud, enforce these Terms, or comply with law.

2. The Services

• Story Maps and Story Studio: tools for building a route, adding photos, memories, music, traveler characters, and playback, then sharing the finished Story Map by link.
• Planner: pre-trip tools for building as you book, estimating retail cost, planning cash and points, mapping trip pieces, and tracking potential savings.
• Fruglar Plus: a recurring self-service upgrade with increased Story Map limits and additional customization features.
• Done-for-you services: optional creative services in which Fruglar builds and polishes a Story Map, with an optional Custom Trip Song or separately quoted creative work.
• Travel services: travel research, quotes, and agent-assisted booking with third-party travel suppliers.

Features, limits, and availability may evolve. The checkout page or order confirmation controls if it differs from a general description in these Terms.

3. Story Map Plans and Limits

Free Story Maps

At the time of this update, a free account may upload up to 50 photos per Story Map and keep one Story Map link publicly active at a time. Free creation includes a limited character wardrobe, per-leg outfit changes, basic transportation, and the Fruglar music library as shown in the product.

Fruglar Plus

At the time of this update, Plus permits up to 150 photos per Story Map, up to five active public Story Map links, custom soundtrack upload, the full standard character wardrobe, and additional ride customization. Plus does not include unlimited storage, bespoke character artwork, Done-for-you editing, a Custom Trip Song, or commercial/white-label use unless expressly stated.

Downgrades

Canceling Plus does not delete your Story Maps. Plus remains active through the end of the paid billing period. When Plus ends, the free limits apply. If more Story Map links are public than the free plan allows, Fruglar may automatically turn the older excess links private while keeping the Story Maps in the account. You can choose which eligible Story Map to share. Content already above a free editing or upload limit is not deleted solely because of the downgrade, but additional uploads, edits, publication, custom audio, or premium customization may be restricted until you reduce usage or reactivate Plus.

4. Subscriptions, Renewal, and Cancellation

Plus is offered as an automatically renewing monthly or annual subscription at the price shown at checkout (currently $7 per month or $49 per year). By subscribing, you authorize Stripe to charge the selected payment method at the start of each billing period until you cancel.

You may cancel online through Premium > Manage billing, which opens the Stripe billing portal. Cancellation stops future renewal charges and normally takes effect at the end of the current paid period. Deleting the app, making a Story Map private, or stopping use does not by itself cancel billing. We may change a subscription price with advance notice required by applicable law.

If a renewal payment fails, we or Stripe may retry the charge and request updated payment information. Plus access may be limited or removed if payment remains unpaid. We will not charge a cancellation fee.

5. One-Time Done-for-you Services

The standard Done-for-you Story Map is currently $49.99 for one trip and includes a route and stops, up to 150 customer-selected usable photos, one Fruglar library soundtrack, one proof, one round of minor revisions, and a target delivery within seven business days after all usable materials and required answers arrive.

A Custom Trip Song is a $50 add-on; the combined Story Map + Custom Trip Song package is currently $99.99. The customer may provide general direction, names, moments, pronunciation, requested words, or original lyrics. Additional proofs, photo curation from a larger camera roll, extensive rewriting, restoration, MP4/social exports, group or wedding work, rush delivery, white-label output, and custom character art are outside the standard package unless included in a written quote.

Delivery timing pauses while required materials, approvals, or feedback are missing. Minor revisions adjust errors, wording, order, or reasonable creative details within the original scope. A new concept, new source material after production begins, extensive song changes, or additional versions may require a new quote.

6. Refunds and Billing Disputes

Subscriptions

Subscription charges are generally non-refundable once a billing period begins, except where required by law or when Fruglar approves an exception. Cancel before renewal to avoid the next charge. If you believe a charge is incorrect, contact us promptly so we can investigate.

One-time creative services

You may request cancellation and a refund before Fruglar begins reviewing, downloading, editing, composing, or otherwise working with your submitted materials. Once work begins, the purchase is generally non-refundable because production time and digital services have been committed. If Fruglar cannot fulfill the purchased scope, we may offer a correction, substitute, partial refund, or full refund as appropriate. Nothing in this section limits non-waivable consumer rights.

A refund, chargeback, or dispute may pause or remove the related subscription, service credit, public output, or fulfillment. Please contact us before filing a payment dispute so we have an opportunity to resolve the issue.

7. Your Content and Required Permissions

You retain ownership of photos, text, audio, and other content you submit. You grant Fruglar a non-exclusive, worldwide, royalty-free license to host, store, reproduce, crop, transform, stream, transmit, display, and otherwise process that content only as reasonably necessary to operate the Services, create requested outputs, support your account, and display content you choose to publish.

You represent that you have all rights and permissions needed for submitted content, including:

• permission from identifiable travelers whose name, image, voice, or likeness you upload or publish;
• parental or legal authorization for any minor shown;
• rights to photos, captions, lyrics, recordings, logos, and other creative material; and
• authority to make the content public when you enable sharing.

You must not upload content that is unlawful, invasive, defamatory, exploitative, infringing, deceptive, or harmful. We may remove content or disable sharing when we reasonably believe these Terms are violated.

8. Public Links and Group Templates

Story Maps begin private. When you turn on sharing, anyone with the link may view and reshare the published content. Fruglar cannot prevent a viewer from taking a screenshot or recording playback. Regenerating the link or turning sharing off disables the Fruglar URL, but it cannot recall copies another person already made.

If you create a group template, you authorize Fruglar to let other users copy the selected route structure into their own account. Templates are designed to exclude your photos and private planning details. Review the template before distributing its code or link.

9. Music, Custom Songs, and Social Platforms

• Fruglar library music: remains owned by or licensed to Fruglar and is licensed for playback within the applicable Fruglar Story Map. It may not be downloaded, extracted, sold, or redistributed as a standalone track.
• Your music: you may upload music only if you own it or have permission for the intended public use. Fruglar may request proof or reject a track.
• Custom Trip Songs: unless a written order says otherwise, the purchaser receives a personal-use license to use the delivered song in the Story Map and share the finished personal trip story, including on personal social accounts. Fruglar retains its platform, production methods, templates, and reusable assets.

Social networks apply their own automated copyright, audio, format, and length rules. Fruglar cannot guarantee that Facebook, Instagram, TikTok, YouTube, or another platform will accept, preserve, monetize, or play an exported video or song. Commercial advertising, resale, broadcast, white-label, or client work requires written licensing or an agency package.

10. AI-Assisted Drafting

AI assist can draft trip names, dates, route stops, and itinerary legs from text you provide. AI output may be inaccurate, incomplete, duplicated, or out of order. You are responsible for reviewing all drafted content before saving, relying on, or publishing it. AI output is not a confirmed booking and should not be used as the sole source for schedules, entry rules, safety information, prices, or reservations.

11. Travel Planning, Prices, and Bookings

Planner retail values, savings, cash targets, recommendations, and points estimates are informational estimates, not guaranteed final prices or savings. Verify all prices, availability, schedules, benefits, and terms with the applicable provider.

Travel bookings are governed by supplier terms, payment schedules, cancellation penalties, insurance terms, and availability. Fruglar acts as an intermediary and is not responsible for a supplier's acts, omissions, insolvency, schedule changes, cancellations, delays, or service quality. You are responsible for passports, visas, health requirements, insurance decisions, and timely review of booking documents.

An eligible confirmed Fruglar booking may include one Done-for-you Story Map after travel and an optional Custom Trip Song at no extra cost for the primary traveler or traveling household. The benefit has no cash value, is not transferable, depends on timely delivery of usable materials, and may be voided if the related travel booking is canceled.

12. Acceptable Use

You agree not to misuse the Services, bypass plan or storage limits, scrape or harvest data, probe security, upload malware, impersonate others, spam, infringe rights, interfere with playback or infrastructure, or use the Services for unlawful or abusive activity. Automated or high-volume agency use requires written approval.

13. Fruglar Intellectual Property

The Fruglar name, software, Story Map player, designs, templates, route animations, character bodies, transportation assets, documentation, library music, and other platform materials are owned by or licensed to Fruglar. Except for the limited right to use the Services under these Terms, no platform ownership is transferred to you.

14. Third-Party Services

The Services rely on third parties such as Stripe, Supabase, Netlify, mapping providers, analytics providers, AI providers, travel suppliers, and social platforms. Their terms and availability may apply. Fruglar is not responsible for an outage, policy decision, or action controlled solely by a third party.

15. Service Changes and Termination

We may modify, suspend, or discontinue a feature to maintain security, control cost, comply with law, respond to a provider change, or improve the product. We will make reasonable efforts to avoid unnecessary loss of paid access and to provide notice of material changes where appropriate. You may stop using the Services at any time; subscription cancellation is governed by Section 4.

16. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." FRUGLAR DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OPERATION, ERROR-FREE AI OUTPUT, PERMANENT THIRD-PARTY AVAILABILITY, OR THAT A PARTICULAR SOCIAL PLATFORM WILL ACCEPT AN OUTPUT.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRUGLAR AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST TRAVEL VALUE, OR THIRD-PARTY SUPPLIER LOSSES. FRUGLAR'S TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID FRUGLAR FOR THE AFFECTED SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW.

18. Indemnity

To the extent permitted by law, you agree to indemnify and hold Fruglar and its operators harmless from third-party claims arising from content you submit, your lack of required permissions, your misuse of the Services, or your violation of these Terms.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before filing a claim, each party agrees to make a good-faith effort to resolve the issue informally by written notice. Unless applicable law requires otherwise, disputes will be brought in a state or federal court with jurisdiction in Texas.

20. Changes to These Terms

We may update these Terms as the Services or legal requirements change. We will update the date above and provide additional notice when required. Changes apply prospectively from their effective date.
